§ 11-27. Exemptions.

  • (a)

    This article shall have no application to financial institutions chartered under state or federal banking laws; or to security firms duly licensed under federal or state laws; nor to transactions between such institutions or firms and their customers. Further, this article shall have no application to the following:

    (1)

    Firms where the purchase of precious metals is for use in the firm's manufacture or repair of goods;

    (2)

    Businesses which regularly recover precious metals from its processes, such as photography and film development;

    (3)

    Purchases of items, made of precious metals, by local retail or wholesale merchants, when such items are to be resold locally, without a change, in form (except, minimal changes may be made, as long as the item remains recognizable as the original item); and

    (4)

    Consumers purchasing on retail or wholesale markets items made or partially made of precious metals.

    (b)

    This article shall have no application, nor be effective, within the boundaries of any municipality within the county which shall have a municipal ordinance that licenses or regulates dealers in precious metals; otherwise, this article shall be in full force and effect throughout the county.
