§ 17-4. Service charge for funding of a 9-1-1 emergency telephone system.*

  • (a)

    A service charge of five (5) percent shall be levied on the basic tariff rate approved by the public service commission on all telephone access lines of any telephone system within the unincorporated area of Pulaski County for the establishment and maintenance of a 9-1-1 Public Safety Communications Center.

    (b)

    The percentage of the service charge may be modified by the quorum court from time to time as necessary to fund the operation of the 9-1-1 system and communications center by simple amendment to this section or collection may be suspended for certain periods of time if it is determined that adequate revenues are currently available.

    (c)

    Said service charge shall be collected by all telephone service suppliers who provide telephone access service within the unincorporated limits of Pulaski County at such time as all service suppliers establish appropriate billing and collection procedures.

    (d)

    Amounts collected from said service charge shall be remitted to the Pulaski County comptroller no later than sixty (60) days after the close of each calendar month. Pulaski County shall be responsible for the collection of said amounts to Pulaski County and the municipal entities within Pulaski County after deducting monthly compensatory administrative fee for the recurring costs of implementation management of the 9-1-1 system.

    (e)

    The service suppliers shall be entitled to retain, as an administrative fee, an amount equal to one per cent of the amount collected.

    (f)

    Revenue collected hereunder shall be remitted to the county and shall be accounted for separately from other county revenues and any increase accrued by deposit or investment shall be credited to the 9-1-1 account.

    (g)

    9-1-1 revenues may be expended for only such expenditures as are allowed by Act 683 of 1985. These expenditures shall be recommended and budgeted in accordance with normal county procedures and budgetary processes. The 9-1-1 account shall be maintained in a separate account by the county treasurer and shall be used to reimburse the General Fund of Pulaski County for those approved expenditures.
