§ 2-101. Ethics—Disclosure of the employment of any relatives—Required.

  • Pursuant to Ark. Code Ann. § 14-14-801 and 14-14-1202, the following policy is hereby adopted to provide for the management of Quorum Court affairs:

    (a)

    All members of the Quorum Court are required to file a written statement with the county clerk disclosing the existence, or lack thereof, of any relatives employed by Pulaski County. Such statement shall identify all known relatives currently employed with Pulaski County, and shall be filed by all Quorum Court members no later than January 31 st of each year beginning in 2006, so as to alert the public to any possible violation of Ark. Code Ann. § 14-14-1202(a).

    (b)

    For the purpose of this ordinance a relative is defined as: mother, father, son, daughter, husband, wife, brother, sister, mother-in-law, father-in-law, brother-in-law, sister-in-law, uncle, aunt, nephew, niece, first cousin, grandfather, grandmother, grandson, and granddaughter, step-children, and step-parents.

    (c)

    Employee is defined as any individual who is providing labor to Pulaski County for salary or wages normally payable from county funds, including but not limited to full-time, part-time, temporary full-time, temporary part-time, and acting temporary full-time at the time the statement is filed.

    (d)

    Lack of knowledge of familial relationship is a defense to violation of this ordinance. The county clerk shall notify any Quorum Court member who fails to provide the required disclosure by the prescribed deadline and shall give them fifteen (15) calendar days to correct the error.

    (e)

    In the event the disclosure is not filed within the correction period, the county clerk shall notify the Pulaski County Sheriff that the statement has not been filed. The Sheriff shall issue a citation for violation of this ordinance as prescribed by law.
