§ 3-17. Definitions.

  • As used in this article, the following terms shall mean:

    Animal control officer means any person appointed by the director to perform duties as assigned by the director to effectuate this article.

    Arkansas Rabies Rules and Regulations means that set of guidelines which were adopted by the Arkansas State Board of Health on January 28, 1971, the amendments thereto which were adopted by the same board on July 24, 1975, and such other amendments as may hereafter be adopted.

    Animal shelter means any premises approved by the director for the purpose of enforcing this article and used as a shelter for seized, stray, homeless, abandoned or unwanted dogs, cats or other animals. It matters not whether the shelter is owned by Pulaski County and operated under the supervision of the director or whether it is owned and operated by a municipality, humane society or animal welfare group, which has a working agreement with the director for the support of Pulaski County.

    At large means any animal not confined to the premises of the owner.

    Citation means a written notice that animal control officers are authorized to issue an owner, requiring an owner to appear in district court to answer charges that a violation of section 3-26 has occurred, if the animal control officer has probable cause, based on the following:

    (1)

    An eye-witness citizen complaint; and,

    (2)

    Substantial evidence to support the citizen's complaint; or,

    (3)

    Actions of the dog witnessed by the animal control officer.

    Dangerous dog means any member of the canine (dog) family which, when unprovoked, has attacked any person or domestic animal, but did so in manner that did not result in physical injury or property damage.

    Director means the director of the Pulaski County Animal Services or the person responsible for effectuating this article and, within the guidelines and funding established by the Pulaski County Quorum Court, the individual granted authority to hire animal control officers and other personnel to perform this function under his supervision.

    Exotic and wild animals means animals native to North America other than those animals generally recognized as being domesticated animals, as well as animals native to foreign lands, whether first generation imported or born here in captivity.

    Owner means any person owning, keeping or harboring a dog, cat or other animal within Pulaski County except for the five (5) municipalities listed in section 3-16 of this article.

    Restraint means either, confinement of an animal to owner's property, by placing within a building, by fencing, or by affixing a chain or leash to the animals' collar and attached to some substantial stationary object adequate to prevent the animal from running at large, or, when off the owner's property, to be under control by leash or other recognized control methods. Hunting dogs, when accompanied by their owner on the hunt, are considered to be under reasonable restraint, as long as the animal has affixed to it a collar with hunting tag and current rabies vaccination tag, and a tag with the owner's name, address and/or phone number. Under this circumstance, the owner will not be subject to a fine, unless the animal has caused damage. Stock dogs used for herding livestock, when accompanied by the owner and being used in herding livestock, are considered to be under reasonable restraint, as long as animal has affixed to it a collar with current rabies vaccination tag, and a tag with the owner's name, address and/or phone number. Under this circumstance the owner will not be subject to a fine, unless the animal has caused damage.

    Stray means any animal which does not have affixed to it a collar with the name of the owner, owner's address and/or owner's phone number, and a current rabies vaccination tag.

    Tattoo means permanently identifying a dog deemed vicious, by the procedures set forth in section 3-26, with the acronym "PCV" and the animal control number for the dog, on the dog's abdomen, on the upper side of the left rear leg.

    Vaccination means the injection of an antirabies vaccine in the manner and frequency set forth in the Arkansas Rabies Control Act.

    Vicious dog means any member of the canine (dog) family which, when unprovoked or unteased, has attacked a person or another domestic animal with such severity as to cause physical injury or property damage.
