§ 4-7. Fee for probationary services.

  • (a)

    Established. A fee for probationary services provided by the county is hereby established.

    (b)

    Amount. A fee of twenty dollars ($20.00) per month shall be imposed on each probationer who is placed on probation by a county circuit court or the county municipal court.

    (c)

    Collection. The amount levied under subsection (b) of this section will be collected on a monthly basis by the county treasurer; a receipt will be given by the treasurer to the probationer, who will present such receipt to his probation officer as proof of payment. Funds collected by the treasurer shall be deposited in the county general fund.

    (d)

    Application. The probation fee established in this section shall apply to all probationers in the county circuit court and the county municipal court and shall be considered a condition of probation. A probationer's failure to pay such fee in accordance with the terms of this section shall be cause for revocation of the probationer's probation. In the event this condition of probation is not enforced by any court, subject to the terms of this section, an action may be commenced in civil court for the collection of those fees established in this section.

    (e)

    Special account. Should any division of the circuit court, or the Sixth Judicial District participate in the Arkansas Adult Probation Program and receive state funds therefrom, fifteen dollars ($15.00) of the aforesaid twenty dollar ($20.00) fee shall be deposited by the county treasurer in a special account to be expended in accordance with the rules of the adult probation commission and/or the specific terms and conditions of such grant.
