§ 8-21. Private, for-profit providers.

  • The business of collection and disposal of solid waste from commercial and/or residential customers within the unincorporated area of Pulaski County will be governed by the following regulations:

    (a)

    To be properly licensed to engage in the business of collection and disposal of solid waste for residential customers within the unincorporated area of Pulaski County, an individual, firm, company or corporation must have a contractual agreement with the Department. Any unlicensed collection and disposal of solid waste within the unincorporated area of Pulaski County is prohibited and the Department will seek the penalties enumerated in [section] 8-23 for violations.

    (b)

    To be properly licensed to engage in the business of collection and disposal of solid waste for commercial customers within the unincorporated area of Pulaski County, an individual, firm, company or corporation shall register with and be licensed by the Regional Recycling and Waste District.

    (c)

    An individual, firm, company or corporation engaged in the business of collection and disposal of solid waste for commercial customers within the unincorporated area of Pulaski County shall provide the following information to the Department within thirty (30) days of request:

    (1)

    Name of entity and address.

    (2)

    A detailed list by name and address of commercial customers to which they are providing service. Updated lists shall be submitted to the Sanitation Department quarterly.

    (3)

    Evidence of contractual agreement with a sanitary landfill approved and permitted by the Arkansas Department of Pollution Control and Ecology to receive solid waste.

    (4)

    Evidence of payment to any sanitary landfill which the individual, firm, company or corporation has received services from.
