§ 8-33. Definitions.

  • The following words, terms, and phrases, when used in this article, shall have the meanings ascribed them in this section, except where the context clearly indicates a different meaning.

    (1)

    "Junk" means old or scrap copper, brass, rope, rags, batteries, paper, trash, rubber debris, and waste or junked, dismantled, or wrecked automobiles, or parts thereof, or iron, steel, and other old or scrap ferrous or nonferrous materials;

    (2)

    "Garbage" means the animal or vegetable waste resulting from the handling, preparation, cooking and consumption of food;

    (3)

    "Rubbish" means refuse, or worthless material including, but not limited to, an occupiable structure which is unsightly, unsanitary, or the remains from an occupiable structure, which has been destroyed by fire, to the degree that it presents a hazard to the community;

    (4)

    "Unsightly" means junk, garbage or rubbish which has been substantially destroyed by fire, decayed, or become dilapidated to the degree that it is no longer adequate for the purpose for which it was originally intended;

    (5)

    "Unsanitary" means the presence of junk, garbage or rubbish, creating a hazard to the community, causing stagnant pools of water, or any other thing, place, or condition that might become a breeding place for mosquitoes and germs harmful to the health of the community;

    (6)

    "Occupiable" means a structure:

    a.

    Where any person lives or carries on a business or other calling;

    b.

    Where people assemble for purposes of business, government, education, religion, entertainment or public transportation; or,

    c.

    Which is customarily used for overnight accommodation of persons;

    (7)

    "Owner" means the holder of title of an occupiable structure and any person in whose name tax bills on property is submitted. "Owner" also means any person who, individually, jointly, or severally with others:

    a.

    Has legal title to any occupiable structure, with or without accompanying actual possession thereof; or,

    b.

    Has charge, care, or control of any occupiable structure, as owner, mortgagee, or vendee in possession, assignee of rents, lessee, or other person in control of an occupiable structure, or his duly authorized agents. Any such person thus representing the actual owner shall be bound to comply with the provisions of this article, and of the rules and regulations adopted pursuant to this article, to the same extent as if he were the owner.

    (8)

    "Structure" means that which is built or constructed or a portion thereof;

    a.

    "Structure" specifically excludes from its definition the following:

    1.

    Land valued as agricultural property that is being farmed or otherwise used for agricultural purposes; and,

    2.

    Improvements or conditions on a parcel of land, larger than ten (10) acres, if the unsightly or unsanitary conditions on the parcel are not visible from a public road or highway.

    (9)

    "Necessary Corrective Action" means

    a.

    Abating or eliminating junk, garbage, or rubbish;

    b.

    The property owner making repairs, razing, or removing rubbish; or

    c.

    The Pulaski County Public Works Department making repairs, razing, or removing Rubbish;

    (10)

    "Public Works" means the Pulaski County Public Works Department;

    (11)

    "Director" means the Pulaski County Public Works Director or her designee.
