§ 4-10. Per diem fee for housing youth from other counties in the county juvenile detention facility.

  • (a)

    A fee of eighty dollars ($80.00) per day is hereby established for housing of youth from other counties in the Pulaski County Juvenile Detention Facility. This fee shall be payable monthly to Pulaski County by the county requesting that a youth be detained and as billed monthly by the Pulaski County juvenile detention facility.

    (b)

    Any county desiring to utilize the Pulaski County juvenile detention facility for housing of youth from its county, shall so indicate in writing its agreement to pay subject fee, and to abide by procedures established by this section and by the Pulaski County judge, prior to the actual detention of any youth. This agreement shall be on form(s) prepared and provided by the Pulaski County juvenile detention center and shall be signed by either the county judge or his representative of the county requesting that a youth be detained. Similar forms shall be utilized to document the release of any youth from the detention facility back to the custody of the sheriff or his representative of the sending county.

    (c)

    Any available bedspace at the Pulaski County juvenile detention facility, in excess of ten (10) beds for males and five (5) beds for females, may be made available for use in detaining youth from other counties, at the discretion of the Pulaski County judge. The detention facility supervisor shall reserve the ten (10) beds for males and five (5) beds for females as a minimum available at all times for Pulaski County youth.

    (d)

    The Pulaski County judge or his representative shall ensure that all youth detained at the Pulaski County juvenile detention facility have been properly detained by the law enforcement authority requesting such, and that proper procedures are followed and documentation is made with regard to all youth detained in the Pulaski County juvenile detention facility.
