§ 8-23. Penalties.

  • (a)

    Any person, private carrier, company or corporation convicted of a violation of sections 8-21 or 8-22 of this article, or any rule regulation or order of the Pulaski County Court concerning disposal of solid waste issued pursuant thereto shall be assessed a fine of not less than five hundred dollars ($500.00) for first offense, nor more than one thousand dollars ($1,000.00) for second offense.

    (b)

    Other penalties for violation of any part of this article include;

    (1)

    That violator may also be required to remove solid waste disposed in violation of this article and to dispose of it in an approved sanitary landfill.

    (2)

    That those persons, private carriers, companies or corporations who violate section 8-21 or 8-22 of this article or any rule, regulation or order of the Pulaski County Court concerning the disposal of solid waste issued pursuant thereto for the third time and who are found to have committed prohibited acts in furtherance of commercial enterprise, whether or not that enterprise is the disposal of waste, shall be assessed a fine not to exceed one thousand dollars ($1,000.00) and in the case of a licensed private hauler, revocation of license. Additionally, those persons convicted may be required to remove any solid waste disposed of in violation of this article and to dispose of it in an approved sanitary landfill.
